Prior to 2013, dealers had been specifically exempted from the CFPB’s regulation under the Dodd-Frank Act. Not only did the CFPB over-reach their authority with the guidance relating to dealers’ processing financing, the data that these regulators were basing their fines on was outrageously flawed. In May, dealers and your customers won a major victory when Congress and the President voided the CFPB’s 2013 guidance – a NADA priority for the last five years!Orange County Congressional Members Played a Critical Role in National VictoryOn May 9th, Congressional Review Act authority helped pass legislation, which was signed into law by the President to nullify this faulty guidance issued by the CFPB five years ago. Dealers should be especially thankful for the support of these Orange County Members of Congress:Ed Royce vocally supported dealers in his statement to his peers on the House floor, urging Congress to vote to void the CFPB’s 2013 over-stepping.Lou Correa was one of only 11 Democrats who crossed party lines to make the logical vote on this issue. Darrell Issa, Dana Rohrabacher and Mimi Walters voted to support the repeal of the flawed guidance issued by the CFPB.
